第五章 监督检查Chapter 5 Supervision and Inspection
第三十四条 旅游行政管理部门应当依法加强对旅行社和外国旅行社常驻机构的监督管理，维护旅游市场秩序。Article 34 Tourism administration department shall strengthen supervision and management of travel agencies and standing agencies of foreign travel agencies and maintain tourism market order according to law.
第三十五条 旅行社应当接受旅游行政管理部门对其服务质量、旅游安全、对外报价、财务账目、外汇收支等经营情况的监督检查。Article 35 Travel agency shall accept supervision and inspection of its service quality, tourism safety, foreign quotation, financial accounts and income and expenditure of foreign exchanges by the tourism administration department
旅游行政管理部门工作人员执行监督检查职责时，应当出示证件。Staffs of the Tourism administration department shall produce certificates in case of conducting supervision and inspection.
第三十六条 旅游行政管理部门对旅行社每年进行一次年度检查。旅行社应当按照旅游行政管理部门的规定，提交年检报告书、资产状况表、财务报表以及其他有关文件、材料。Article 36 Tourism administration department shall conduct one annual inspection of travel agencies. And travel agencies shall submit annual inspection report, balance sheet, financial statements and other relevant documents and materials according to the regulations of the tourism administration department.
第三十七条 旅游行政管理部门应当加强对质量保证金的财务管理，并按照国家有关规定将质量保证金用于赔偿旅游者的经济损失。任何单位和个人不得挪用质量保证金。Article 37 Tourism administration department shall strengthen financial management of the quality guarantee deposit, and use such quality guarantee deposit for compensating economic losses of the tourists according to relevant stage rules. Any unit or individual shall not misappropriate quality guarantee deposit.

第六章 罚则Chapter 6 Punishment Provisions
第三十八条 违反本条例第十二条第二款、第十六条第二款规定的，由旅游行政管理部门责令停止非法经营，没收违法所得，并处人民币1万元以上5万元以下的罚款。Article 38 In case travel agency violates provisions in paragraph 2 of Art.12 and paragraph 2 of Art.16 of the “Rules”, the tourism administration department shall order such travel agency to suspend illegal business, confiscate illegal income and impose a fine between RMB 10,000 to RMB 50,000 yuan.
第三十九条违反本条例第十七条第一款、第二十一条、第二十二条第一款、
第二十四条、第二十五条第一款、第三十二条、第三十三条规定的，由旅游行政管理部门责令限期改正；有违法所得的，没收违法所得；逾期不改正的，责令停业整顿15天至30天，可以并处人民币5000元以上2万元以下的罚款；情节严重的，并可以吊销《旅行社业务经营许可证》。Article 39 In case travel agency violates paragraph 1 of Art.17, Art.21, paragraph 1 of Art.22, Art.24, paragraph 1 of Art.25, Art.32 and Art.33, the tourism administration department shall order such travel agency to rectify its operation within a prescribed time limit, and confiscate illegal income if any. In case such travel agency fails to rectify its operation within the prescribed time limit, the tourism administration department shall order such travel agency to suspend and reorganize operation for 15-30 days, and may impose a fine between RMB 5,000 to 20,000 yuan. In case of serious violation of such provisions on the part of such travel agency, the tourism administration department may cancel its “Travel Agency Business License”.
第四十条 违反本条例第十八条、第二十条第二款规定的，依照《中华人民共和国商标法》、《中华人民共和国反不正当竞争法》的有关规定处罚。Article 40 In case travel agency violates Art.18 or paragraph 2 of Art.20, it shall be punished according to relevant provisions in “Trademark Law of PRC” and “Law of People’s Republic of China against Unfair Competition”.
第四十一条 违反本条例第二十六条、第三十五条第一款规定的，由旅游行政管理部门责令限期改正，给予警告；逾期不改正的，责令停业整顿3天至15天，可以并处人民币3000元以上1万元以下的罚款。Article 41 In case the travel agency violates Art.26 or paragraph 1 of Art.35, the tourism administration department shall order such travel agency to rectify operation within a prescribed time limit and give warning to such travel agency. Otherwise, the tourism administration department shall order such travel agency to suspend and reorganize operation for 15-30 days, and may impose a fine between RMB 3,000 to 10,000 yuan.
第四十二条 旅行社被吊销《旅行社业务经营许可证》的，由工商行政管理部门相应吊销营业执照。Article 42 In case the travel agency has its “Travel Agency Business License” cancelled, the industrial and commercial administrative department shall cancel its business license correspondingly.
第四十三条 旅游行政管理部门受理本条例第二十三条规定的投诉，经调查情况属实的，应当根据旅游者的实际损失，责令旅行社予以赔偿；旅行社拒不承担或者无力承担赔偿责任时，旅游行政管理部门可以从该旅行社的质量保证金中划拨。Article 43 The Tourism administration department shall order travel agency to make compensation after handling complaints provided for in Art.23 of the “Rules” and confirming the circumstances to be true through investigation. In case the travel agency refuses to or is unable to undertake responsibility to make compensation, the tourism administration department may transfer compensation money from the quality guarantee deposit of such travel agency.
第四十四条 旅游行政管理部门或者对外经济贸易主管部门违反本条例规定，有下列情形之一的，对负有责任的主管人员和其他直接责任人员依法给予行政处分：Article 44 In case the tourism administration department or the competent foreign economic and trade department violates the provisions of the “Rules”, administrative punishment shall be grated to the responsible personnel in charge of work and other direct responsible personnel according to law.
（一）对符合条件的申请人应当颁发《旅行社业务经营许可证》或者《外商投资企业批准证书》而不予颁发的；(1) “Travel Agency Business License” or “Approving Certificate for Foreign-Funded Enterprise” that shall be granted is not granted to the qualified applicant.
（二）对不符合条件的申请人擅自颁发《旅行社业务经营许可证》或者《外商投资企业批准证书》的。(2) Issue “Travel Agency Business License” or “Approving Certificate for Foreign-Funded Enterprise” to unqualified applicant without authorization.
第四十五条 旅游行政管理部门工作人员玩忽职守、滥用职权，触犯刑律的，依法追究刑事责任；尚不够刑事处罚的，依法给予行政处分。Article 45 In case working staffs of the tourism administrative department neglect their duties, misuse powers or violates criminal law, they shall be ascertained for criminal responsibility according to law, or be granted with administrative punishment according to law in case criminal punishment is not applicable.
第七章 附则Chapter 7 Supplementary Provisions
第四十六条 香港特别行政区、澳门特别行政区和台湾地区的旅游经营者在内地投资设立旅行社，比照适用本条例。Article 46 In case tourism operators from Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan area establish travel agency in inland China, such “Rules” shall be applicable.
第四十七条 本条例自发布之日起施行。1985年5月11日国务院发布的《旅行社管理暂行条例》同时废止。Article 47 The “Rules” shall be enforced since the date of promulgation. “Provisional Regulations for Management of Travel Agency” promulgated by the State Council on May 11, 1985 shall be mollified simultaneously. |
